You agree that Commvault and/or its licensors may collect, process, and use technical information (which does not personally identify you) for commercial purposes, as well as limited personal data (names, business contact information), each collected in connection with product maintenance and support services provided to you as part of the Software. Except where the GDPR applies (in which case see paragraph below), you hereby consent to Commvault`s use, storage or processing of such data or information in the United States (or any other country in which we operate) for the purpose of providing you with related software and services. In addition, you consent to Commvault correctly using your company name and logo for sales and marketing purposes, including on our website, social media, press releases and other marketing materials. If you do not agree, you can unsubscribe by sending an email to Commvault at customerchampions@commvault.com. 7.6. Taxes. Your fees under this Agreement exclude all taxes or duties payable in respect of the Software in the jurisdiction where payment is made or received. To the extent such taxes or duties are payable by Atlassian, you must pay Atlassian the amount of such taxes or duties in addition to any fees due under this Agreement. Notwithstanding the foregoing, you may have received an exemption from the relevant taxes or duties at the time those taxes or duties are collected or determined. In such event, you have the right to provide Atlassian with such exceptional information and Atlassian will use reasonable efforts to provide billing documents that will enable you to obtain a refund or credit for the amount so paid from a competent tax authority if such refund or credit is available. Apps made available through the App Store are licensed to you, not sold. Your license for each Application is subject to your prior acceptance of this Licensed Application End User License Agreement (“Standard EULA”) or a custom End User License Agreement between you and the Application Provider (“Custom EULA”), as applicable. Your license for an Apple App under this Standard EULA or Custom EULA is granted by Apple, and your license for a Third Party App under this Standard EULA or Custom EULA is granted by the application provider of that Third Party App.

Any Application subject to this Standard EULA is referred to herein as a “Licensed Application”. The Application Provider or Apple (“Licensor”) reserves all rights in the Licensed Application not expressly granted to you under this Standard EULA. These Terms and Conditions, Warranties, Limitations and Remedies contain a breakdown of risk between you and Commvault. As a result, Commvault`s prices reflect this risk allocation. Because some jurisdictions limit the ability to exclude implied warranties, limit or exclude incidental or consequential damages, or limit liability, the above limitations and exclusions may not apply to you. “Order” means atlassian`s applicable order documents or other purchasing processes related to this Agreement. Orders may include the purchase of software licenses, support and maintenance, ancillary services, increased or improved scope of use, or renewals. “Atlassian Policies” means the Atlassian Terms of Use, privacy policy, Online Community Platform Terms of Use, Support Policy, Enterprise Support and Service Policy, Third Party Code Terms in Atlassian Products, and (unless otherwise specified) any other policies or terms set forth in this Agreement. Confidential Information: You agree that any information provided to you by Commvault that is confidential or proprietary in nature, including but not limited to software, hardware products and related terms, prices and documentation, will be considered Commvault Confidential Information.

You may not disclose Commvault Confidential Information without Commvault`s prior written consent. You may disclose your Confidential Information to Commvault so that Commvault can provide its services or products, provided that you mark such information as “confidential” or “proprietary”. 6.1. Support and Maintenance. During the period for which you have paid the applicable support and maintenance fees, Atlassian will provide support and maintenance for the Software in accordance with the Atlassian Support Policy and the Enterprise Support and Services Policy (if applicable). Support and maintenance of the Software includes access to new versions, if any, and all references to the “Software” in this Agreement include new versions. Unless this Software is provided to you for beta, demonstration, test or evaluation purposes, or is marked as “Not for resale, as further described herein, you agree to use the Software solely for the operation of your internal data center and any access to the Software, documentation or other user information accompanying the Software; to limit only to those of your employees who clearly need such access for your internal data processing operations. .
